The District Customer Grievance Redressal Forum has asked Mahi Land Developers and Builders to give possession of land to the customer at earliest after completing all necessary formalities or return the advance payment received with interest.
The complainant was lodged against the realtor by Nitin Tagde, a resident of New Subhedar Layout resident. The forum said, the plot must be handed over to the customer after receiving the remaining amount of Rs 3 lakh 95 thousand along with the sale deed and registry. In case there is any technical or legal problem, then the realtor will have to return Rs 1 lakh 81 thousand to the customer with 14 percent interest.Â
The forum has ordered the developers to give interest till the date of payment (from 16 December 2014). Along with this, the forum also told the realtor to pay Rs 20,000 towards the physical and mental problems caused to Tagde and Rs 5 thousand towards legal expenses. The developers were given one month to implement this decision. The president of the forum Sanjay Patil, members Chandrika Bais and Subhash Ajne gave this decision.
According to the complaint, Tagde had signed an agreement with Mahi Developers to buy a plot in the layout at Mauja Ghorpad, Tehsil Kamptee for Rs 5 lakh 76 thousand. He gave Rs 1 lakh 81 thousand to the developers. The remaining amount was to be paid by August 13, 2015. According to this, the customer showed readiness to give the remaining amount and also asked to register the plot. But the developers did not respond.
Hence the customer issued a legal notice to the developers. But he did not respond. Therefore, the customer filed a complaint in the forum, which issued notice to the developers. But the firm did not turn up. Therefore, the forum acted unilaterally on the complaint.
