A blow for the Dr.Ashish Arunrao Chaudhari as his writ petition was turned down by Justice Ravi Deshpande and Justice Amit Borkar at the Nagpur bench of Bombay High Court.As per information,they granted him ten day’s time to vacate the area in the building of Ratnaprabha Thakur near Panchsheel Library in Gandhinagar locality. The area is sanctioned for parking space and the petitioner is running his OPD.The court is also directed him to raze the construction on the portion at his own cost.
If he fails to do so, the civic body has given the authority to do the demolition work after ten day and to recover the cost of the said demolition from the petitioner.Earlier; the civic administration was served a notice to the said petitioner to remove the OPD in the concerned area. And the petition was filed against the notice.
And during the hearing of the petition the civic body’s counsel said that the NMC has issued the notice to comply with the HC’s direction of October 15, 2015, in the PIL 65/2012 for clearing the illegal constructions in the area sanctioned as parking spaces. So court with reference to the PIL passed an order to quash the petition because to allow the petition means an impediment in the execution of the order passed by the court in the said PIL.The court also observed that it cannot permit such things to go on and if the NMC does not take initiative to execute the order, it will treat as contempt of court and serve notices to it.
