VIA Taxation & Corporate Law Forum organized an interactive meet with State GST Officers on Maharashtra Amnesty Scheme 2022 (The Maharashtra Settlement of Arrears of Tax, Interest, Penalty or Late Fee Act, 2022) today, 26th April, 2022 at VIA Auditorium, Nagpur.
Chief Guest, Anantha Rakh, Addl Commissioner, State GST, Nagpur Division, briefed about the objective of the scheme that the Maharashtra Government has come out with the most liberal and lucrative amnesty scheme for various taxes levied by State Government before the introduction of Goods and Services Tax (GST). The scheme is brought in as an act named as Maharashtra Settlement of Arrears of Tax, Interest, Penalty or Late Fee Act, 2022.Â
He emphasized the taxpayers to take full benefit of the amnesty scheme 2022 and if there are any difficulties faced the taxpayers can contact State Tax officials for clarifications. While answering queries from participants he added that the amnesty scheme will provide a big relief to trade and industry. Taxpayers will have an opportunity to avail the scheme and close all pending disputes of pre-GST era, mainly under VAT and CST.
Guest of Honour, V D Kamthewad, Jt Commissioner (ADM), State GST, Nagpur said that taxpayers, consultants should come forward and avail the waivers given in the Amnesty Scheme at earliest. He further said that there will be no rejection under the scheme and even if anyone fails to pay full amount under amnesty, the proportionate benefit of the schemes will be extended to the taxpayers.
Sunil V Lahane, Dy Commissioner, State GST, Nagpur informed that the scheme shall apply to all pending dues under specified State legislations for the period upto 30th June 2017, i.e., before the introduction of GST. He further informed that duration for submission of application under the scheme has commenced on 1st April 2022 and will end on 30th September 2022. He has made a very detailed presentation on the scheme and explained who can avail the benefit of the scheme, procedure of application, payment options etc. Starting his presentation he informed that under this amnesty scheme if there are departmental dues outstanding from any taxpayer upto Rs 10000/-, it will be 100% waived off by passing of suemoto order by the Department. While explaining who can take benefit of the scheme, he said that the scope of applicants has been expanded in this Amnesty scheme 2022 compared to previous amnesty schemes, here any person registered or unregistered, third parties like financial institutions can also avail the benefit of this scheme.
Earlier, Suresh Rathi, President – VIA welcomed the guest speakers and in his welcome address said dealers who have availed benefits under the previous amnesty schemes as well as cases litigated by the State department are also eligible for settlement under this scheme. The amnesty scheme is likely to provide a big relief to businesses. Taxpayers will have an opportunity to avail the scheme and close all pending disputes of pre-GST era.
