The Supreme Court has taken a strong stance on misleading advertisements, declaring that celebrities and social media influencers will be held equally accountable if they are involved in deceptive commercials.
During its hearing in the Patanjali Ayurved case, where it also reprimanded the Indian Medical Association earlier in the day, the court mandated that broadcasters must submit a self-declaration form before airing any advertisements, confirming compliance with relevant regulations.
In Tuesday’s hearing, Justices Hima Kohli and A. Amanullah referenced the Guidelines for Prevention of Misleading Advertisements and Endorsements (2022), highlighting Guideline 13, which emphasizes endorsers’ responsibility to ensure they have sufficient knowledge or experience with the product or service they promote, and that it is not deceptive.
