The Additional District Consumer Disputes Redressal Commission has directed M/s Happy Home Developers to refund ₹6,63,900 plus 9% interest to two customers, along with ₹35,000 each for mental and physical harassment and reimbursement of legal costs.
The commission, bench-led by President Satish Sapre with Milind Kedar presiding, ruled in favour of complainants Vandana Wasu and Sarika Dahake, who had invested in plots at Brahmani village in Kalmeshwar Taluka. Wasu had signed an agreement on December 19, 2012, for two plots worth ₹3,76,658, and paid ₹23,47,100 by August 5, 2015. Dahake entered into a similar agreement on April 12, 2013, for ₹3,70,150, paying ₹3,16,800 by November 5, 2014. Despite these payments, the builder failed to execute and register the sale deeds, prompting the complaints.
Rejecting the developer’s justification, the commission held that withholding payment and depriving buyers of possession constitutes an unfair trade practice and deficiency in service. As a result, Happy Home Developers is obliged to issue full refunds, cover interest and legal fees, and compensate both women for the distress caused.
