The Nagpur bench of the Bombay High Court has ordered Sant Gadge Baba Amravati University to grant a B.Sc. Computer Science degree to a student who was mistakenly admitted to the course without having studied Mathematics in her HSC (Higher Secondary Certificate) exams. The student, Adiba Ismat Mohd. Shuja Rizwi (22) from Akola, had enrolled at Shivaji College of Arts, Commerce and Science, Akola, and successfully completed all six semesters of the B.Sc. programme. However, after finishing her final semester, her result was unexpectedly withheld, leading her to approach the court for relief.
A division bench comprising Justice Mukulika Jawalkar and Justice Pravin Patil ruled in favour of the petitioner, stating that the student alone could not be held responsible, as both the college and the university were at fault. The Court observed that the college had granted admission without proper verification, and the university subsequently issued her hall tickets and allowed her to appear for all six semesters without raising any objections.
The bench strongly objected to the use of WhatsApp messages between the University and College officials about the petitioner’s ineligibility. It said that such informal communication cannot be treated as valid or official, especially in serious matters like cancelling a student’s admission. The Court called this practice “highly condemnable” and stressed that decisions affecting a student’s academic future must be made in a “proper and official manner.”
The university argued that the student’s admission was invalid because she hadn’t studied Mathematics in her HSC subjects. However, the Court ruled that since the University had already issued her admit card and allowed her to complete the entire course, it could not later withhold her result. “It is not a case of any fraud or misrepresentation on the part of the petitioner: She has successfully completed her course and was made a scapegoat due to administrative negligence,” the bench observed. The Court directed the University to issue her B.Sc (Computer Science) degree and all related certificates without delay.
