Petitioners will now move to Supreme Court once again seeking justice to medical post-graduation students as Judges of Nagpur Bench of Bombay High Court, Justice Sunil Shukre and Justice S M Modak, dismissed the petitions challenging the ordinance issued by State Government for making Maratha reservation applicable with retrospective effect.
The move by the High Court has paved way for making Socially and Educationally Backward Classes (SEBC) reservation applicable to Maratha students in admissions to post-graduate (PG) medical and dental courses.
Maharashtra Government had announced Maratha quota under SEBC category for PG medical and dental courses, after which many people opposed the move. Some students approached the High Court, which ruled that the quota would not be implemented from the current academic session.
The Supreme Court upheld the decision. This irked the Maratha community students and they started agitation. Against this backdrop, Maharashtra Government called a special meeting of the Cabinet and issued an ordinance making the SEBC reservation applicable with retrospective effect.
Some students had approached the Supreme Court to challenge the legality and validity of the said ordinance. The Supreme Court asked the petitioners to approach the High Court, following which the petitioners filed the petition before Nagpur Bench of the Bombay High Court.
Meanwhile, the Supreme Court directed that no further petition/ application in respect of the admission for the present academic year would be entertained by any court, as there was already delay in admission of medical students throughout Maharashtra.
The Apex Court issued the directions on June 4, while hearing another special leave petition challenging the economically weaker section (EWS) quota. The petitioners then filed application before the Supreme Court seeking clarification/modification of the order issued on June 4.
