Additional district consumer complaints redressal forum has ordered Infratech Real Estate Company to pay back Rs.4.80 lakh of a consumer with 18 percent rate of interest and also pay Rs.25000 towards mental harassment suffered by the consumer with Rs.10000 additionally towards the disposal of the case. The interest is payable on Rs.2.40 lakh out of Rs.4.80 lakh from November 5, 2009 while on remaining Rs.2.40 lakh, the interest is payable from January 11, 2011 until actual payment of dues. The court has given a timeframe of 30 days for the payment of dues.
If the company fails to pay the dues during this period, the company would be liable to pay penalty of Rs.50 per day thereafter till the actual payment of dues. The consumer has been identified as Devendra Nakade, a resident of Desaiganj from Gadchiroli district. His application was disposed of by the members of the forum Smita Chandekar and Avinash Prabhune.As per information Nakkade had purchased a villa from the Infratech company under its Marvel scheme for Rs.12 lakh and 5 thousand .He also paid Rs.4.80 lakh out of total sum in two installments to the company.However,the company failed to undertake any construction at the site and also did not give possession of the villa to the Nakkade.Registered sale deed was also not executed in favour of the buyer, compelling him to lodge a complaint at the Additional Consumer Complaints Redressal Forum.
