Nagpur Police, under the Government of Maharashtra, issues guidelines to ensure public safety during New Year celebrations. The directive targets crime prevention and peace maintenance in (specifically bars, permit rooms, restaurants, event places etc.) located within the jurisdiction of Nagpur City Police Commissionerate, it it is directed as follows:-
1) All establishments arranging 31 December events, in addition to their routine daily events, shall take written permission of the Commissioner of Police, Nagpur City.
2) All bars/permit rooms shall strictly adhere to the outer time limit of 05:00 A.M. and shut their establishments by 05:00 A.M. sharp. All indoor music performances may continue till 05:00 A.M.
3) No entry of children below the age of 18 years shall be allowed in the designated area of “permit room” where liquor is being served. For outdoor events, where liquor is being served after obtaining temporary license for a day, children below 18 years should not be allowed entry. The mandated age criteria as per the prevailing excise rules shall be followed and in particular, no person below the age of 25 years shall be served liquor. All existing rules and regulations issued by the government in respect of excise permit conditions shall be strictly adhered to.
4) No eating house/dhaba/establishment which does not possess a valid excise license shall allow drinking or sale of liquor to its customers.
5) Customers shall not be allowed to dance in the seating area which may cause annoyance to the adjoining groups of guests and thereby leading to conflicts/altercations between different groups of guests.
6) All such establishments shall strictly comply with the Noise Pollution (Regulation and Control) Rules, 2000 amended from time to time, along with the various court judgments in this regard. All establishments shall ensure that proper acoustic sound proofing of such establishments is done so that there is no leakage of sound or noise outside the premises. For all outdoor events, music shall shut at midnight 12:00 A.M. sharp. For all indoor events, permissible time limit for sound/music is till 05:00 A.M.
7) CCTVs shall be installed in the premises to cover all points of entry, exit, serving area, seating area, bar counter etc. and must not exclude any area where the members of the public are ordinarily present. Two sets of DVRs shall be maintained to ensure the smooth functioning of CCTVs, in case the police has taken the original DVR for verification of any unruly behaviour or incident upon being reported.
8) All such establishments shall ensure that appropriate number of such male and female security personnel are present at all times to manage their customers and it shall be ensured that these security personnel shall not by any means indulge in any act, which may constitute to be an offence under the prevailing laws of the land.
9) The overall responsibility to maintain the safety, security and dignity of guests including women who intend to enter or are within such establishments, shall rest with the owners of such establishments. Safety of women, in particular, shall be given the TOP MOST PRIORITY.
The police may order closure of ongoing events, if they are found to be violating guidelines.
10) Regulating the parking and ensuing traffic outside the premises shall be the sole responsibility of the owners of such establishments.
11) It shall be the responsibility of the owners of such establishments that the persons who were served liquor do not drive a vehice upon their exit. Special personnel shall be deployed. to ensure compliance of the above. The establishments shall also display signages/banners regarding drunken driving being illegal.
12) Assessment in respect of persons creating ruckus or unruly behaviour shall be done by the establishment staff/management and service of liquor to such unruly persons shall be stopped forthwith and they be evacuated appropriately by the security personnel well before their conduct causes annoyance to other guests.
