Nagpur Bench of State Consumer Complaints redressal forum has dismissed the appeal of director of Tajshree Cars and owner of show room Emperor Honda for selling faulty car to a customer.Avinash Bhute had challenged the order of District Consumer Complaints Redressal Forum passed on September 21, 2018 through an appeal giving relief to the customer on February 19, 2019.The ground for rejecting the appeal was stated to be the delay on behalf of Tajshree Cars to challenge the decision of the forum. As per the information, original complainant Ram Karhu had purchased a car from Tajshree Cars priced at Rs.12, 32,738.The car was handed over to him on March 31, 2017.
After purchasing the car, he noticed various deficiencies in the car forcing him to lodge number of complaints with the dealer.However, no cognisance of his complaints was taken, forcing the consumer to lodge a complaint with the District Consumer Complaints Redressal Forum. The forum on examining the proofs on record asked Tajshree Cars to give a another brand new car to Karhu in place of the old car or return Rs.12,32,738 paid by Karhu to Tajshree Cars with ten percent rate of interest. The forum also ruled that the Tajshree Cars should pay Rs.30000 towards the mental and physical harassment suffered by the complainant along with Rs.10000 as expenses towards the disposal of the case. The said order was challenged by the Tajshree Cars on February 26, 2019 which was considered as inordinate delay by the forum.
