Rajesh Swarnakar and six other senior citizens have filed a Public Interest Litigation in the Nagpur Bench of the Bombay High Court against the food plaza being built in Veer Savarkar Garden on Khamla Road. It has been claimed in the petition that this food plaza is illegal.
The Veer Savarkar nagar layout was approved by Nagpur Improvement Trust and Municipal Corporation on 28 January 1969. A garden has been developed on the open land in the layout.
Citizens of Veer Savarkar nagar, Vikas nagar, Deo nagar, Vivekananda nagar and Central Excise Colony use this park for morning and evening walks. Do yoga and exercise. Toys for children have been installed in the park. However, some social activists have attempted to make commercial use of this park for financial gain.
The construction of a food plaza has been started in the park without the permission of the administration. As a result, the provisions of the Maharashtra Land Revenue Code, the Maharashtra Regional Urban Planning Act and the Maharashtra Municipal Corporation Act have been undermined.
The case was heard on Wednesday before Justices Atul Chandurkar and Vrishali Joshi. The court then issued notices to the Principal Secretary of the Urban Development Department, the Chairman of Nagpur Improvement Trust, the Municipal Commissioner and the Collector and ordered them to file their reply within three weeks.
