Justice Nitin W. Sambre and Justice Vrushali V. Joshi of the High Court have directed that Prachi Gajanan Tewale, the petitioner, be granted admission to the 3rd Semester (2nd Year) of the BE Computer Science and Engineering course for the academic session 2025-26. This decision follows the commitment made by the respondent, the Engineering College at Akola, which is operated by the Shivaji Education Society.
The High Court, while resolving Prachi’s writ petition, noted that it is the responsibility of the respondent State authorities to resolve the issue. The court emphasized that the petitioner should not be held responsible for the delay in her claim, as the University’s late declaration of results was beyond her control. It also stated that she could not be expected to handle an impossible situation like fixing the University’s delay in announcing the results.
In this situation, the respondent admission authority should have considered the delayed declaration of results and adjusted the admission process accordingly with sensitivity.
The High Court noted its dissatisfaction with the claim made by the respondent, the Director of Technical Education. It highlighted that the petitioner, a deserving and meritorious student, was unjustly denied admission due to circumstances beyond her control. The court emphasized that the respondents should have addressed these issues more effectively.
The High Court observed that the college is ready to consider and grant the petitioner’s admission, acknowledging the delay in the declaration of results. Advocate S.S. Shingane represented the petitioner, while AGP N.R. Patil (State) and K.P. Mahalle (College) appeared for the respondents.
