Justice Abhay J. Mantri, the Vacation Judge at the High Court, has ‘requested’ DSGI N.S. Deshpande to accept the notice of the writ petition filed by student Kalyani Vijay Chakrawar. The petition requests permission for her to take part in the remaining rounds of counseling for admission to AIIMS. Kalyani explained that she missed the flight on the scheduled date, which is why she couldn’t attend the counseling earlier.
The petitioner’s counsel, AA Kathane, has submitted that the petitioner has challenged Rules 3.2.2 (i) and 3.2.2 (ii) of the Counseling Rules, arguing that they are unreasonable and disproportionate. The petitioner claims that these rules violate her fundamental right to seek admission to the respondent institute.
The counsel has highlighted that the petitioner secured an All India rank of 119 in the examination. The petitioner participated in the counseling round conducted by AIIMS for admission and seat allotment. However, due to missing her flight, she is now considered ineligible to participate in the further rounds of counseling with the respondents.
DSGI waived notice for the respondents and instructed them to take necessary action in the matter. The High Court has scheduled the case for further hearing on December 31, 2024, to consider the issue of interim relief.
