In a major relief for a young job aspirant, the Bombay High Court at Nagpur has ruled that a scar left after tattoo removal cannot be a valid reason to reject a candidate for recruitment in the Central Armed Police Forces (CAPFs).
As per a media report, the petitioner, 22-year-old Ganesh Sarnaik from Washim district, had applied for the Constable (GD) post under CAPFs, SSF, and Assam Rifles as per the 2023 notification. However, the CRPF recruitment board declared him unfit on September 28, 2024, citing a scar on his right forearm caused by tattoo removal.
Ganesh challenged the decision in court, arguing that the recruitment rules did not mention disqualification due to such scars. His lawyer also assured that Ganesh was ready to undergo treatment to reduce the scar, if required.
A division bench of Justice Nitin Sambre and Justice Sachin Deshmukh ruled in Ganesh’s favor, stating there was no valid reason to declare him unfit. The judges also referred to earlier cases where candidates with minor physical marks or scars, including tattoo-related ones, were allowed.
The court made it clear that a tattoo removal scar — even on the saluting arm — cannot be used as a reason for disqualification if not mentioned in the recruitment guidelines.
