New Delhi: The Supreme Court of India has called for sex education to be introduced at an earlier stage in the school curriculum, asserting that awareness about puberty, consent, and responsible behaviour should not be delayed until high school.
The observation came on Wednesday during the hearing of a bail plea involving a 15-year-old boy accused of sexually assaulting a minor girl, a case that brought attention to the need for early education on sexual development and behaviour.
A bench of Justices Sanjay Kumar and Alok Aradhe remarked that both the accused and the victim were adolescents, highlighting that children should be guided about physical, emotional, and social transitions much earlier than Classes IX to XII.
The case stems from a First Information Report (FIR) filed on October 20, 2023, at Hayat Nagar police station in Sambhal district, Uttar Pradesh. As per the complaint, the Class 10 girl was allegedly coerced into a sexual act by the boy at his residence. The incident came to light after the girl became pregnant, prompting legal proceedings under Sections 376 and 506 of the IPC, along with Section 6 of the POCSO Act, according to Live Law.
The Juvenile Justice Board (JJB) had initially rejected the boy’s bail plea, a decision that was later upheld by the sessions court and the Allahabad High Court. However, the Supreme Court intervened in September 2025, granting interim relief and ordering conditional release. On October 8, the Court confirmed its decision, overturning the High Court’s ruling.
During the hearing, the Uttar Pradesh government informed the bench that, in line with NCERT guidelines, sex education is currently introduced only from Class IX onwards. The Court, however, expressed dissatisfaction with this framework, stating that awareness should begin much earlier to help children understand consent, bodily autonomy, and responsible behaviour.
The apex court urged the education authorities to review and strengthen the curriculum, ensuring that it better equips students to navigate adolescence with sensitivity and understanding.
