 Failure to give timely possession of flats, HC issues notices to builders

A notice period of three weeks has been issued to the builders of First City Township after the buyers of this real estate property appealed to the Nagpur Bench of Bombay High Court as there has been no update in the possession of the flats to them. This is the second time that the buyers have approached the court for the same. Previously, the builders had assured HC to look after the matter and hand over the possession of the flats to their buyers.

The new notice has been issued on Friday, under the division bench comprising justice Sunil Shukre and Milind Jadhav.According to the Association of Purchasers, counsels, Firdos Mirza and Tejas Deshpande the new builders had assured that the possession would be handed over to the owners by December 2019. But now these same builders are asking the buyers to give a clean chit to the earlier builders Reatox and Chourangi. The new builders also failed to provide amenities like club house and other mentioned facilities in the original agreement.

According the petitioners, the Maharashtra Airport Development Company (MADC) on September 22, 2005 had selected Reatox for development of modern township on 31 acres of land at Khapri, after which the land was handed over to the builders, Reatox on June 6, 2006.

Reatox agreed to the completion of work within a span of two years. The petitioners even mentioned that they had entered into a tripartite agreement with MADC and SBI in July, 2008. They pointed out that they had already paid 75% of the amount and now are paying the loan instalments.
