Mumbai: The Maharashtra government on Monday introduced the Maharashtra Private Placement Agencies (Regulation) Act, 2025, aimed at regulating private placement agencies engaged in job placement activities. The bill seeks to enhance transparency, protect job seekers from exploitation, and prevent fraudulent recruitment practices.
With the growing role of private placement agencies in employment generation, the government emphasized the need for regulation to ensure ethical recruitment practices. The bill recognizes private agencies as key players in modern human resource management, contributing to better job opportunities and employment conditions.
Key Provisions of the Bill
The proposed legislation prohibits private placement agencies from operating without a valid registration certificate. It also includes provisions for the cancellation or suspension of registration if agencies are found guilty of misrepresentation, suppression of material facts, or violation of legal provisions.
To oversee compliance, the bill proposes the establishment of a State Controlling and Monitoring Authority to supervise implementation. Additionally, local offices will facilitate coordination between private placement agencies and job seekers to improve employment mobilization efforts.
Penalties for Violations
The bill outlines strict penalties for non-compliance. Agencies found operating without registration could face imprisonment of up to three years and a fine of up to ₹1 lakh. Other violations will attract fines ranging from ₹50,000 to ₹3 lakh.
Furthermore, in cases where offences are committed with the consent, connivance, or negligence of directors, managers, or other officials of a private placement agency, they will be held accountable and face legal action.
Additional Initiatives
The legislation also proposes job fairs, career guidance programs, counseling workshops, and seminars in collaboration with registered private placement agencies. The objective is to create a synergy between government agencies, job seekers, and employers, facilitating better skill-matching and employment opportunities in both domestic and overseas markets.
