The Nagpur Bench of the Bombay High Court on Thursday stayed the demolition order on the residences of Ahefaz Afsar and M Safwan Abdul Rashid, both accused in the Nagpur riots. The High Court earlier had stayed the bulldozer action on the houses of three accused.
Five accused have been granted interim relief by the court. Nagpur Municipal Corporation issued a notice of demolition of the illegal portion on March 21, following which Ahefaz’s brother Shahbaz and Safwan’s wife Shibia Sahar moved the court. The bench of Justice Nitin Sambre and Justice Vrushali Joshi stayed the demolition orders.
The court had snubbed Nagpur Municipal Corporation after the residence of the main accused, Faheem Khan was demolished. The court has sought a reply from the Municipal Commissioner by April 15.
NMC started action immediately after Chief Minister Devendra Fadnavis said that the cost of the damage would be recovered from the guilty in the riots. NMC started issuing notices to the accused and started action. The action was halted by the High Court.
