In a major relief for Maharashtra’s industrial sector, the Supreme Court has reportedly dismissed the Revenue Department’s Special Leave Petition (SLP) challenging the Bombay High Court judgment that struck down the levy of GST on assignment of leasehold rights in industrial land transactions. The development is being viewed as a landmark victory for industries operating on MIDC leasehold plots across Nagpur and several other industrial regions of the state.
The dispute centred on whether the transfer of leasehold rights by an original allottee to another party should attract GST. Earlier, the Bombay High Court had ruled that such transactions amount to transfer of immovable property rights and therefore cannot be classified as a taxable “supply of service” under GST provisions. The court had observed that once leasehold rights are permanently assigned, the original holder’s rights are completely extinguished, making the transaction similar to a transfer of property rights rather than a leasing service.
After the Bombay High Court verdict, the Revenue Department approached the Supreme Court seeking reversal of the ruling. However, the apex court has now reportedly refused to interfere, thereby strengthening the relief granted to industries. The detailed order copy is still awaited.
