Nagpur: The Nagpur Bench of the Bombay High Court has revoked permission for a Garba and Dandiya event at Mor Hindi Upper Primary School, Ramdaspeth, after organisers repeatedly breached noise regulations.
The order came in response to a petition filed by local resident Pawan Sarda, who complained that loud DJ music during the festivities was causing significant disturbance in the neighbourhood. Earlier, the Ramdaspeth Plot Owners’ Residents Association, which was organising the celebrations, had assured the court that an independent agency would be engaged to monitor and control sound levels within legal limits.
Despite these assurances, noise levels recorded on October 21 and 22, 2023, were found to be far above permissible limits. Police inspections conducted between October 19 and 22 revealed decibel levels ranging from 73.8 to 103.9, much higher than the threshold set by law.
Although the Assistant Commissioner of Police had initially granted approval for the festival from October 15 to 24, 2023, the order was conditional on strict adherence to sound norms, with violations warranting automatic cancellation. However, authorities did not withdraw permission despite repeated complaints, prompting the petitioner to approach the court again.
On October 20, 2023, the organisers had reiterated before the court that they would comply with noise restrictions, and the court had directed police to ensure strict enforcement. With violations persisting, the High Court annulled its earlier order of October 13, 2023, which had allowed the event, and cancelled the permission altogether.
The petitioner was represented by senior advocate M.G. Bhangde.
