The Nagpur Bench of the Bombay High Court has temporarily stopped an order that asked staff of private unaided and minority colleges to do census work. The court also sent notices to officials, including the Central Home Department Secretary and Census officers, asking them to reply by April 24.
A bench of Justice Anil Pansare and Justice Nivedita Mehta said the order seems illegal at first glance under existing laws. The order, issued on April 6 by a municipal census officer, had asked employees of Guru Nanak College of Pharmacy to take part in census duties.
The college challenged this in court.The college’s lawyer argued that the order was unfair, illegal, and a misuse of power, referring to rules under the Census Act and a previous High Court judgment.
