In a major development concerning long-pending encroachments on government land in Kachipura, the Maharashtra Urban Development Department has upheld the Nagpur Municipal Corporation’s (NMC) stand, paving the way for the demolition of unauthorized commercial structures in the area.
The decision comes after the state government rejected an appeal filed by several businessmen challenging NMC’s action against constructions on land associated with the College of Agriculture under Dr. Panjabrao Deshmukh Krishi Vidyapeeth (PDKV). The appeal had sought permission for regularization and construction approvals on the disputed land.
According to officials, a detailed review established that the land is owned by the Maharashtra government, while PDKV is only the lessee. Authorities also noted that the land has been reserved under the city’s development plan for public purposes, including cultural facilities, transport-related infrastructure, and parking.
Based on these findings, the government concluded that NMC’s refusal to grant building permissions was legally justified.
The dispute has remained unresolved for more than a decade. Following a final hearing conducted through video conferencing at Mantralaya on June 22 and 23, Additional Chief Secretary (Urban Development) Aseem Kumar Gupta issued the ruling, clearing legal hurdles that had delayed enforcement action.
Officials said large portions of the land have been occupied by commercial establishments over the years, including shops, restaurants, garages, event lawns and automobile service centres. With the state government’s decision now in place, civic authorities are expected to initiate action against the unauthorized structures in accordance with planning and municipal laws.
NMC had earlier issued notices to several occupants and rejected applications seeking building plan approvals. Civic officials stated that the latest ruling strengthens the corporation’s position and enables it to proceed with the removal of encroachments on the disputed land.
