In a significant ruling, the District Consumer Disputes Redressal Commission has held as illegal the decision of ICICI Lombard General Insurance Company to reject an insurance claim arising from an accident involving a luxury car. The Commission directed the insurer to pay the complainant Rs 30.13 lakh along with interest at the rate of 9 per cent per annum.
The Commission also ordered the insurance company to pay a total compensation of Rs 30,000 towards physical and mental harassment suffered by the complainant, as well as litigation expenses. The complainant, Manish Agrawal, met with an accident involving his luxury car in Nagpur on January 25, 2021. Following the incident, an authorised dealer inspected the vehicle and estimated the repair cost at Rs 41.05 lakh.
However, the insurance company rejected the claim, alleging that Agrawal had concealed material facts and furnished false information. Aggrieved by the decision, he approached the Consumer Commission seeking redressal.
After examining the evidence and documents submitted by both parties, the Commission observed that even the insurer’s own investigation report did not contain any adverse findings against the complainant. Advocates Kamal Satuja and Saurabh Poddar represented Agrawal before the Commission.
