The High Court has directed the Central Government to submit an affidavit clarifying how many underpasses are being constructed across the country and under what scheme. The court has also asked for details of the departments involved in the process, including the Ministry of Environment, the Ministry of Railways, and the State Governments.
The bench observed that while railway crossings cause significant traffic congestion and safety hazards, underpasses are essential to ensure smooth vehicular movement and prevent accidents. However, the court questioned why many proposed underpass projects are delayed despite approval and funding.
The court further noted that while the Central Government has initiated several underpass construction projects, the pace of implementation remains slow. It emphasized that the government must submit clear data on the number of underpasses sanctioned, the number completed, and the ones currently under construction.
The High Court also instructed the concerned authorities to explore alternative solutions, including overbridges and road diversions, in locations where underpass construction faces technical or environmental constraints. It underlined that timely execution is crucial since traffic and public inconvenience increase during prolonged construction.
The court has given the government time to file a detailed affidavit before the next hearing, stating exact numbers, timelines, and the responsible implementing agencies.
